The University of Wisconsin no longer considers research using existing data sets as being "exempt" from IRB review. Instead, they view it as research that does not involve human subjects and that is the reason it does not need to be reviewed by the IRB. AAHRPP, the accreditation agency, accepts this view as accurately describing why the research does not need IRB review.
